Land of Oz General Activity Release and Assumption of Risk and Release of Claims

WHEREAS, Emerald Mountain, Inc. Emerald Mountain Development, Inc and Emerald Opportunities, Inc. owns and operate the Land of Oz facility and nearby other land necessary for the use, access, and maintenance of the Land of Oz (the “Premises”).

WHEREAS, the guest named below, on behalf of themselves and any minors accompanying them (collectively, “Guest”), desires to access the Premises.

NOW, THEREFORE, for and in exchange for being allowed access to the Premises, the Guest agrees to this following Notice and Assumption of Risk and Release of Claims (the “Agreement”).

Waiver and Release. Guest on behalf of themselves agrees that at all times during any visit to the Premises they will be solely responsible for the supervision of (either as their parent or acting in loco parentis for) all minors accompanying Guest. Further, Guest, on behalf of themselves and all minors attending with Guest, does hereby, and to the fullest extent allowed by law, release and forever discharge and hold harmless Emerald Opportunities, Inc., Emerald Mountain Development, Inc and Emerald Mountain, Inc., and their directors, shareholders, officers, employees, volunteers, agents, successors, and assigns (collectively, “Emerald”) of and from any and all liability, claims, demands, and causes of action, of whatever kind of nature, either in law or equity (collectively, “Claims”), which may hereafter arise from Guest’s access and use of the Premises.

Assumption of Risk. Guest understands that their participation (or participation of a minor in Guest’s group), visit, and tour at the Premises may include activities that may be hazardous to Guest. Guest further recognizes and understands that such participation may involve certain inherently dangerous activities. Guest hereby expressly and specifically assumes the risk of injury or harm in the activities and releases Emerald from all liability for injury, illness, death, and/or property damage that may result. To the extent not caused by Emerald’s negligence, Guest, to the fullest extent allowed by applicable law, shall indemnify Emerald of and from any Claims arising out of or relating to Guest’s negligence in supervising any minors in its group.

Guest understands and acknowledges that this Agreement and the releases herein discharge Emerald from any liability or claim that Guest may have against Emerald, with respect to any bodily or other injury, illness, COVID-19 illness, death, or property damage that may result from Guest participation. Guest understands that Emerald does not assume any responsibility or obligation to provide financial assistance or other assistance, including, but not limited to, medical, health, or disability insurance, in the event of injury, illness, death, or property damage.

*COVID-19 Release: Guest assumes exclusive responsibility to safeguard themselves from, and assumes the inherent risk of exposure to, the COVID-19 virus. Emerald is not responsible for illnesses arising out of, relating to, or in any way linked to COVID-19. Guest shall not attend the tour if they are experiencing any flu or COVID-19 symptoms, and shall promptly notify Emerald if they begin experiencing any such symptoms on the tour. Emerald has not duty to notify Guest of any potential exposure, though it may do so voluntarily or through the applicable governmental authorities. Emerald reserves the right to prohibit access to the Premises for any reason, including suspicion of COVID-19 symptoms.

Miscellaneous. Guest expressly understands and agrees that this Release is intended to be as broad and inclusive as permitted by law, and that this Release shall be governed by and interpreted in accordance with the laws of North Carolina. Guest agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release. By signing below, Guest acknowledges that they have read and understand this Release, and agree to its provisions.

BY PURCHASING TICKETS THE GUEST HAVE READ AND ACCEPT THIS AGREEMENT and further agree that no oral representations, statements, or inducement inconsistent with the foregoing written agreement have been made.

Online Ticket Sales

Before purchasing tickets, we suggest you carefully review the Terms and Conditions of Sale of the event you are about to purchase.

Autumn at Oz Festival

Refund and Exchange Policy. Exchanges are allowed based on availability for desired date. All ticket sales are final.

Inclement weather conditions will not constitute a refund. Shows and character interactions may be altered as management deems acceptable and appropriate for the weather conditions. Shows may be paused or delayed.

Park & Festival Access. Access to the park and/or festival site is PROHIBITED and refused to, but not limited to, people who:

  • Are under the influence of illegal drugs or any other illegal substances.
  • Are clearly suffering from alcohol intoxication which, in Festivals staff’s sole discretion, has caused You to be in an impaired state.
  • Have been previously banned from festivals and/or other events by the organizer, the administration or legal authorities.
  • Are demonstrating an intent to disturb the peace or to provoke someone else to do so.
  • Engage in fighting or disruptive behavior.
  • Use foul language.
  • Wear clothing with obscene or indecent language.
  • Resist the direction of and search by the Festival security guards and security services.
  • Refuse to declare and forfeits objects that are prohibited, as set forth herein.
  • Distribute flyers or posters on or near the Festival site. If You would like to promote one of Your events, then please visit the official Company website for more information.
  • Act in violation of the provisions of one or more articles of these regulations or in the spirit thereof.

Please note: The Land of Oz is not a fully functioning theme park, and was built on top of a mountain in 1969 prior to the ADA compliance ruling. Due to multiple staircases and uneven paths and hills that have not been altered since 1969, electric scooters and wheelchairs cannot access Dorothy’s house or the Yellow Brick Road. Arrangements can be made for those who are in regular wheelchairs to access the park if made in advance with park management. Arriving without proper arrangements may result in an altered tour of Oz.

Prohibited Items. The following items are not allowed on the park or festival site from outside the festival under any circumstances.

  • Glass of any kind
  • Weapons of any kind (regardless of permit)
  • Paint of any kind (including paint markers and spray paint)
  • Fireworks
  • Drones of any kind
  • Illegal substances
  • Drugs or paraphernalia
  • Alcohol
  • Open or refillable e-cigarettes or vaporizers
  • Laser pointers
  • Inflatables (including balloons)
  • Camera Tripods
  • Pets – due to live animals being used in our productions, we do not allow personal pets onto park grounds. A properly trained and licensed service animal can access the park, but you must notify management of your date of attendance and tour time.

Reserved Shuttle Time. This purchase is for tickets at a designated park entry time at a designated price, as chosen and/or approved by you as the ticket purchaser. Please be sure you are happy with your time selection before finalizing your purchase. You will not be permitted entry to the park if you more than 1-hour arrival earlier than the selected time. Late arrivals will be accommodated at the discretion of Land of Oz considering crowd control and occupancy and travel regulation on park shuttle vehicles and occupancy regulation within the park.

Confirmation Number. Please be sure to record/save your confirmation number, as this is required for replacing lost tickets and locating reservations. Your confirmation page is not a ticket.​

Lost Tickets Policy. Lost tickets will be replaced provided you have your confirmation number available. Please message our ticket sales vendor Showpass to request replacement tickets.

Event Cancellation or Date/Time Change Policy. If this event is effected for any reason by “force majeure,” (see Force Majeure below), Land of Oz will either offer a rescheduled/postponed date or cancel the event completely. In the event of a postponed reschedule date you will have a forty-eight (48) hours window to cancel your tickets for face value refund & taxes refunded (fees are non-refundable), otherwise, you are opting to accept the new dates of the event. In the event of a complete cancellation a refund of the full value of your purchase will be issued. The event is not considered “cancelled” if it is stopped at any point after your ticketed time has started, in which case Land of Oz is not required to refund the purchase for said performance. Land of Oz will accommodate you at subsequent performances when possible.​

Land of Oz reserves the right to change the date and/or time of any performance up to two (2) days before the originally scheduled date of the performance due to unforeseen reasoning. If a change occurs, patrons will be notified immediately engaging the forty-eight (48) hours window mentioned above.

Force Majeure. Land of Oz does not guarantee a refund or exchange on tickets purchased for a performance that is cancelled, or is rescheduled less than five (5) weeks before the original performance date/time, as a result of “force majeure.” “Force majeure” means any event which Land of Oz could not, even with all due care, foresee or avoid. Such events may include pandemic, war or threat of war, riot, civil strife, terrorist activity or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, and all similar events outside Land of Oz’s control. A declared state of emergencies by the State Governor or Local Town Mayor is included in force majeure. In the event of a cancellation or rescheduling due to force majeure, Land of Oz will accommodate you at subsequent shows when possible or reimbursement of your purchase.​

Reselling Policy. Tickets may not be resold or offered for resale. Tickets may not be used for advertising, promotion, or other commercial purposes except with the express written consent of Land of Oz. Land of Oz reserves the right to refuse entry to any customer who has purchased tickets and resold them, or to any person attempting to attend a performance with such tickets.

Reproduction Policy. It is unlawful to reproduce any tickets in any form. In the event of reproduction, Land of Oz reserves the right to refuse entry to the original purchaser as well as any person attempting to attend a performance with reproduced tickets. Tickets are uniquely assigned to the purchaser and those assigned to their party by the purchaser.

Review Upon Receipt. Please review your tickets and confirmation upon receipt. If any detail of your order is incorrect, please contact Showpass immediately. Land of Oz will not be responsible for any discrepancies if you do not contact our ticket sales vendor within 24 hours after receiving your tickets.

Agreement. Submitting a ticket order indicates your AGREEMENT to these terms and conditions.

Private Tours

The following terms and conditions apply to all Land of Oz Private Tours tickets (“Tickets”) purchased on or after May 31, 2021.

By purchasing Ticket(s) you are deemed to have accepted these Terms and Conditions of use. Purchase and use of a Land of Oz Ticket is subject to the regulations of each individual event or other special event (“Event”), copies of which are available onsite at Land of Oz and/or are available upon request. You agree to be bound by these regulations by purchasing a ticket for admission.

Agreement. A contract between you (the “Ticket Holder”) and Emerald Mountain, Inc. and Emerald Opportunities, Inc., (collectively “Emerald” or “Land of Oz”) applying to you and any Ticket Holder enter the Land of Oz facilities; land owned by Emerald.

Payment. You agree to the payment of the selected pricing option. Multiple pricing options cannot be selected and combine for a single tour. This payment must be paid regardless if you meet the maximum tour capacity.

Confirmation Number. Please be sure to record/save your confirmation number, as this is required for replacing lost tickets and locating reservations. The confirmation page is not a ticket.

Lost Tickets. Lost tickets will be replaced provided you have your confirmation number available. Please contact us to request replacement tickets prior to arrival.

Reselling Tickets. Tickets may not be resold or offered for resale. Tickets may not be used for advertising, promotion, or other commercial purposes except with the express written consent of Land of Oz. Land of Oz reserves the right to refuse entry to any customer who has purchased tickets and resold them, or to any person attempting to attend a performance with such tickets.

Reproduction of Tickets. It is unlawful to reproduce any tickets in any form. In the event of reproduction, Land of Oz reserves the right to refuse entry to the original purchaser as well as any person attempting to attend a performance with reproduced tickets.

Review Upon Receipt. Please review your tickets and confirmation upon receipt. If any detail of your order is incorrect, please contact the Land of Oz immediately. Land of Oz will not be responsible for any discrepancies upon arrival if you do not contact us within 24 hours after receiving your tickets.

Cancellation/Rescheduling. Private Tours are conducted during rain or shine. They will not be cancelled due to rain or fog. Deposit/payment will not be reimbursed under such conditions. We would like to request your cancellation up to 48 hours prior to scheduled tour. If you arrive after your ticket time your tour is cancelled with no refund and no rescheduling. We urge all Ticket Holders to arrive at the Meeting Place (located in your booking confirmation) at a minimum of 15 minutes prior to your ticketed time.

Special Notice: If you are showing symptoms of the flu or possibly COVID-19 please call us immediately and we would be more than happy to reschedule you with a minimum of 14 day(s) in advance. This special COVID-19 notice is only allowed up to 12-hours prior to your ticketed time. Notifying less that 12-hours prior to your ticketed time is too late for notice and will be considered a cancellation. [Date: 05/31/2021, valid until August 2021]

When tickets are purchased…
Up to 48 Hours prior: Reschedule Allowed but No Refund.
48-24 Hours prior: See Special Notice Above** but No Refund.
24-12 Hours prior: See Special Notice Above** but No Refund.
12-0 Hours prior: Reschedule Not Allowed but No Refund.

Refunds. All sales are final, no refunds. Rather than cancelling your tour, we recommend rescheduling. Rescheduled tours are only allowed up to 48-hours in advance of your previously schedule tour. If you cannot make your ticketed tour and wait to contact us less than 48-hours prior to that time you forfeit the ability to reschedule.

Force Majeure. Force majeure means any event which Land of Oz could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, terrorist activity or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, wide-spread disease/pandemic, and all similar events outside Land of Oz’s control. In the event of a cancellation due to force majeure, Land of Oz will accommodate you with a subsequent tour time and date, or 100% refund will be issued to those Ticket Holder affected.

Parking. You will meet a Land of Oz Representative at Land of Oz Shop located at 2669 Beech Mountain Parkway, Beech Mountain, NC 28604. From there you will be escorted to the Land of Oz Guest Parking Lot.

The Land of Oz Guest Parking Lot is only accessible by escort of Land of Oz Representatives and is permitted during your ticketed tour time only. Once your scheduled tour ends the you agree to clear the lot in a timely manner. Any vehicles left in the lot beyond 10-hours of their tour’s ticketed time/day could be towed at the vehicle owner’s expense.

The following activities are strictly prohibited in the parking lot and the areas surrounding:

  • Tailgating
  • Sleeping in your vehicle
  • Buying/selling tickets
  • Vandalism, loitering or other illegal behavior
  • Drinking alcohol
  • Illegal drug use​

Land of Oz and its affiliates, together with their respective employees, officers, owners, directors, representatives and agents are not responsible for and assume no liability arising from fire, theft, damage to or loss of any vehicle or any articles left therein. Parking at the event constitutes acknowledgement by the Ticket Holder that he/she/they have read and agrees to the provisions of the foregoing contract. Vehicles (a) remaining in parking area 10-hours after last daily tour or (b) in parking area other than as designated by Land of Oz are, at Land of Oz’s sole discretion, subject to tow-away at owner’s expense.

Private Property. Land of Oz is private property and is not a fully functioning theme park during Private Tours. Upon entering Land of Oz, you recognize that is it a vintage landmark that may have uneven pathways, staircases, and walkways. It is the responsibility of the client to make all persons in their party aware of this.

Property Renovations. Due to ongoing renovations to Land of Oz, You understand that construction may be occurring on site during the time of the tour. You or anyone in your group agree to not photograph or post on social media any construction happenings. The tour guide will provide proper protocol to maneuver around construction. You or anyone in your group are not allowed to stray away from their tour or go near any construction on the Land of Oz property. You understand that Land of Oz is not liable or responsible for any injury sustained during a guided tour due to on site construction.

Injury, Theft, Lost Items. Land of Oz is not liable for any injuries that may occur on the property under any conditions. Land of Oz is not liable or responsible for any personal items lost or stolen during your tour time.

Photography/Filming. You or anyone in your group are allowed to take photos and videos during your tour within these guidelines: (a) You agree upon entering the property that any photographs or film footage taken will only be used for personal endeavors. (b) You are not allowed to utilize photographs or footage for commercial use or producing items for sale. (c) No photographs or videos taken are to be used for any public advertising or published media (digital, print, television, audio) unless Land of Oz grants written permission. Failing to comply with these guidelines will result in a fine of up to $10,000.

We graciously ask as a courtesy that any public posts on social media or printed forums regarding Land of Oz do not contain verbiage pertaining to abandoned, eerie, defunct or the like. This will help Land of Oz maintain the grounds and deter urban explorers from trespassing and vandalizing the property.

Miscellaneous. No pet(s) are allowed at Land of Oz, this includes leashed, caged or contained in your vehicle in our guest parking area.

Private Tours

Refund and Exchange Policy. There are NO REFUNDS and NO EXCHANGES. All ticket sales are final.

Fridays 11am-6pm, Saturdays 10am-6pm, & Sundays 10am-6pm. Last ride down is 5:45pm.

Lift Rules & Regulations. Scenic lift rides are offered during designated festival and operational hours at Beech Mountain Resort during Land of Oz’s Autumn at Oz Festival. The chairlift ride will be used to access the top of the mountain and entry to the Land of Oz Theme Park with breathtaking views stretching for miles. The following list of regulations is associated with a lift ride ticket. Additional regulations not listed may be added.

  • No one is guaranteed access to a lift ride, and lift access can be denied.
  • Times of lift operation may change and are subject to weather conditions.
  • Thunder and lightning and wind may cause the lift to be closed.
  • Riders must be in suitable physical condition to be able to load and unload the lift.
  • Dress should be appropriate for changes in temperature and weather.
  • Proper footwear for walking on the side of a mountain should be worn, flipflops are not allowed.
  • You must be at least 36” tall.
  • No child carriers (such as strollers), no crutches, walkers, or wheelchairs are allowed.
  • Parents are responsible for the safety of their minor children
  • Backpacks must be removed and held on the chair or the passenger’s lap
  • No one that appears to be under the influence of drugs or alcohol will have access
  • No alcohol or open containers are permitted on the lift
  • No dogs or pets are allowed.
  • Riders must be able to fit into a rescue harness.
  • There are no restraint straps or belts on the chairs.
  • Chair lift safety bars must be lowered when riding and raised when entering/exiting the ride.
  • Prior to using any lift, you must have the knowledge and ability to load, ride and unload safely.
  • All 4:00pm lift ticket holders are subject to a one-way trip up and free shuttle bus ride down due to last ride down at 5:45pm.

BEECH MOUNTAIN RESORT & LAND OF OZ RESERVE THE RIGHT TO REFUSE SERVICE TO ANYONE THAT DOES NOT FOLLOW, OR WHO DEVIATES FROM THE REGULATIONS ASSOCIATED WITH LIFT USAGE. PLEASE BE ADVISED OF ALL REGULATIONS PRIOR TO PURCHASING A TICKET. THERE ARE NO REFUNDS FOR RAIN. WE OPERATE WHEN IT RAINS, PLEASE CHECK THE WEATHER PRIOR TO YOUR ARRIVAL.

Lift Ticket Valid Any Day. Valid September 10-26, 2021, 10AM-6PM. Your lift ticket is valid any day of the event. However, we highly recommend you redeem your ticket on the day of your purchased Autumn at Oz festival tickets. You will be boarded on the lift based on your purchased ticketed Autumn at Oz time.

Reserved Lift Time. This purchase is for tickets at a designated park entry time at a designated price, as chosen and/or approved by you as the ticket purchaser. Please be sure you are happy with your time selection before finalizing your purchase. You will not be permitted boarding the lift if you more than 1-hour arrival earlier than the selected time. Late arrivals will be accommodated at the discretion of Land of Oz considering crowd control and occupancy and travel regulation on park shuttle vehicles and occupancy regulation within the park.

Cancellation Policy. All purchases are final and cannot be cancelled, refunded, changed or transferred. We do not guarantee snow conditions, weather conditions or open terrain. Your credit card account has been charged for the total amount of your purchase, regardless of whether or not the purchased ticket(s) is/are used. Credit will not be given for any unused purchases and unused tickets cannot be used towards future purchases.

Lost Tickets Policy. Lost tickets will be replaced provided you have your confirmation number available. Please message our ticket sales vendor Showpass to request replacement tickets.

Private Tours

Transactions.

If you wish to purchase any product or service made available through the Site (each such purchase, a “Transaction”), you may be asked to supply certain information relevant to your Transaction including, without limitation, your credit card number, the expiration date of your credit card, your billing address and your shipping information. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER PAYMENT METHOD(S) UTILIZED IN CONNECTION WITH ANY TRANSACTION. By submitting such information, you grant to Land of Oz™ the right to provide such information to third parties for purposes of facilitating the completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to the acknowledgment or completion of any Transaction.

All descriptions, images, references, features, content, specifications, products and prices of products and services described or depicted on the Site are subject to change at any time without notice. Certain weights, measures and other descriptions are approximate and are provided for convenience purposes only. The inclusion of any products or services on the Site does not imply or warrant that these products or services will be available. It is your responsibility to ascertain and obey all applicable local, state, federal and international laws (including minimum age requirements) in regard to the receipt, possession, use and sale of any item purchased from this Site. By placing an order, you represent that the products ordered will be used only in a lawful manner. All DVDs and similar products sold are for private, non-public, home use (where no admission fee is charged) and may not be duplicated. Land of Oz™ reserves the right, with or without prior notice, to do any one or more of the following: (i) limit the available quantity of or discontinue any product or service; (ii) impose conditions on the honoring of any coupon, coupon code, promotional code or other similar promotion; (iii) bar any user from making or completing any or all Transaction(s); and (iv) refuse to provide any user with any product or service. You agree to pay all charges that may be incurred by you or on your behalf through the Site, at the price(s) in effect when such charges are incurred including, without limitation, all shipping and handling charges. In addition, you remain responsible for any taxes that may be applicable to your Transactions.

Land of Oz™ or our agents at Square, Incorporated may call or text by telephone regarding your account or your Transactions. You agree that we may place such calls or texts using an automatic dialing/announcing device. You agree that we may make such calls or texts to a mobile telephone or other similar device. You agree that we may, for training purposes or to evaluate the quality of our service, listen to and record phone conversations you have with us.

International Shipping.

Land of Oz™ does not provide International Shipping yet, we look forward to serving our fans over seas soon.

Merchandise Display Colors.

Land of Oz™ strives to display as accurately as possible the colors of the products shown on the Site; however, Land of Oz™ cannot and does not guarantee that your monitor’s display of any color will be accurate.

Limitations on Quantity.

Land of Oz™ does not offer additional discounts on large orders of a single item or on large orders of many individual items. In addition, we reserve the right to limit quantities on orders placed by the same account, on orders placed by the same credit card, and on orders that use the same billing or shipping address. We will notify you if such limits are applied. Land of Oz™ reserves the right to prohibit purchases of any merchandise to resellers. Resellers are defined as a company or an individual that purchases goods with the intention of selling them rather than using them.

Availability, Errors & Inaccuracies.

If an item is out of stock, Land of Oz™ may, in its sole discretion and at no extra cost to you, substitute another item for the out-of-stock item if Land of Oz™, in its sole discretion, determines that the identical brand and product is available in a form that is of equal or greater value, for example, larger quantity, packaged with a trial sample, or with updated product packaging.

Land of Oz’s acknowledgement of an order means that your order request has been received; it does not mean that your order has been accepted or shipped or that the price or availability of an item has been confirmed. Land of Oz™ makes a conscientious effort to describe and display its products and services accurately on the Site. Despite these efforts, a small number of items on the Site may be mispriced, described inaccurately or unavailable, and we may experience delays in updating information on the Site and in our advertising on other sites. As a result, we cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability and services. Land of Oz™ reserves the right to change or update information and to correct errors, inaccuracies or omissions at any time without prior notice. We apologize for any inconvenience. As part of our shipping procedures, we verify the availability and the price before an item is shipped. If an item’s correct price is lower than our stated price, we will charge the lower amount and ship you the item. If an item’s correct price is higher than our stated price, if the item is no longer available or if we determine that there were inaccuracies in our product information, we will cancel your order and notify you of such cancellation via email.

Risk of Loss.

Except as otherwise set forth herein, the risk of loss for and title to products purchased on the Site passes to the purchaser upon delivery to the carrier.

Returns.

If you are not fully satisfied with your merchandise purchase, you may return it in accordance with the Return Policy. This Return Policy is incorporated into these Terms & Conditions in its entirety. Most unopened items in new condition and returned within 90 days will receive a refund or exchange. Some items have a modified return policy noted on the receipt, Land of Oz™ policy board (refund exceptions), landofoznc.com or in the item department. Items that are opened or damaged or do not have a receipt may be denied a refund or exchange.

Return Exceptions.

Returns and exchanges without a receipt may be limited. Other restrictions may apply.

If you’re not satisfied with any Land of Oz™ Owned Brand item, return it within one year with a receipt for an exchange or a refund.

​Open music, movies, video games and software cannot be returned, but may be exchanged at the store for the same title, for the same or different gaming platform.

Open or defective collectibles (e.g., trading cards, special edition dolls, porcelain dolls, action figures and die-cast cars) cannot be returned.

All Electronics and entertainment items must be returned within 30 days for a refund or exchange. For these items purchased between 11/1 – 12/25, the 30-day refund period will start on 12/26.

Holiday items and limited-time-only collections may have modified return policies.

Our gift shops cannot accept returns and exchanges of online purchase.

Refunds.

In most cases your refund will automatically go back to the original form of payment used for the purchase. In the event you used multiple forms of payment, your refund may be issued across all payment methods used. Refunds will be issued to the account that you used to purchase the item, even if the account is closed or paid in full. You may also request a refund in the form of a Land of Oz™ GiftCard. For more information about refunds to your third-party credit cards, contact your card-issuing financial institution. Refunds will be credited back to the original payment method within 10 business days after the online return center receives the item.

Declined Returns.

If our online return center has declined a return for any reason, the order will be shipped back to you and you’ll receive an email explaining the details of the declined return. Our online return center will send the order back to you via FedEx® and you should receive it within 7 days. Often times our online return center can reuse the tracking number from your return shipment, so you may be able to use this information to track the return of your declined order.

A return may be declined for one of the following reasons:

  • Your return was outside of the return window.
  • The item appears worn or used.
  • The item was opened.
  • The item was non-returnable or non-returnable if opened.
  • The online return center wasn’t able to locate the order number or other information needed to process the return.
  • The item is not a landofoznc.com item.

Shipping Reimbursements.

Shipping charges may be refunded depending on the reason for your landofoznc.com return. If your shipping charges aren’t refunded, please contact us to see if you’re eligible for a refund. You may not be refunded for shipping charges if:

  • The return was declined by our online return center.
  • The return was not due to an error by Land of Oz™.

Export Policy.

You agree that any purchased goods licensed or sold on the Site, which may include technology and software, and all software, including all HTML code and controls that are contained on the Site, are subject to the customs and export control laws and regulations of the United States of America and may also be subject to the customs and export laws and regulations of the country in which the products are manufactured and/or received. THE COPYING OR REPRODUCTION OF SUCH SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED. By purchasing, downloading or using technology or software from the Site, you agree to abide by applicable laws, rules and regulations including, but not limited to, the Export Administration Act and the Arms Export Control Act, and you represent and warrant that you will not transfer, by electronic transmission or otherwise, the software or technology to a foreign national or a foreign destination in violation of the law.

Rules for Promotions.

Any sweepstakes, contests, raffles or other promotions (collectively, “Promotions”) made available through the Site may be governed by rules that are separate from these Terms & Conditions. If you participate in any Promotions, please review the applicable rules. If the rules for a Promotion conflict with these Terms & Conditions, the Promotion rules will apply.
